I was thinking about making a game about the SMA4 E-reader levels

Should I make it?

I'm not sure of the legality of that, tbh, since it would essentially constitute copying levels right out of a commercial game-related product, when one of the main purposes of that product is to provide those levels.

Personally I wouldn't do it if I were you. It seems to me to be treading the line of commercial game distribution too much.

or generally in fangames

I've never seen a SMB clone with every level from the game in it.

Usually it's just the first level and maybe a few more, and Mario fans in general are highly familiar with the included levels anyway.

To put it another way, it is highly unlikely that people who play SMB "clones" will not bother to play the real SMB just because of that. With this SMA4 e-Reader idea, it may be a different story.

And you're questioning how legal this will be, when fangaming in general is illigal anyway, considering it immitates gameplay of, say, SMB. Even if it has levels made my fangaming developers and not professionals, it doesn't matter because you'll get the same gameplay values anyway.

Fangaming in general is illigal but nothing is done about it because it has spread to about every corner of every fan group ever.

Making a e-reader game is just as illigal as any other fangame. There's no 10/50/95% illigal.

Since making fangames is accepted on this site and considered 'not illigal' by this site's laws, it also means that reproducing the e-reader levels isn't illigal either.

I would play it. I've never had a chance to play those levels.

That's the difference between using a website for research in a project, taking the findings and putting them into your own words, and just copying and pasting the whole lot. The former is acceptable; the latter is not.

In the same way, a Mario fangame takes Mario-related materials and puts them into a uniquely-designed game, rather than just having the exact same levels as the original Mario game did.

If taking the level design from a game and using it in your fangame is such a bad idea, then answer me, why is taking a game engine design (such as SMB3) and using it in your fangame any different? You're still copying the game just as you would with the levels.

I don't see why not, considering you're making quite the few SMB3 engines, might as well make some use of them

I think it's a great idea and I think you should reconsider. The E-reader levels (cards and e-reader itself) were hard to get a hold of and a chance to play them sounds like fun!

If I make it, I'll probably use HME3 but I'll need to add some things into the engine to start using it!
