It seems that Sony is planning to adopt a licensing system that will mean gamers won't own the PS3 titles that they've paid money for. Instead, they will only be purchasing the licence to play the game and that the software itself will still be Sony property - meaning that the disc won't be the customer's to sell.

We assume that the thinking behind this move will ultimately be to stop PS3 games being resold several times - which currently snatches potential sales away from Sony - and to counter the impression in consumers' minds that games are only really worth their pre-owned price and are not worth buying new.

When we contacted Sony, it issued us with the following statement: "We have made all of the official announcements at E3 and cannot make any further comments at this time. We will be announcing more news running up to PlayStation 3's launch."

Not that it's going to stop anyone, but with consoles becoming so intertwined with the internet, it's not inconceivable that if Sony starts really embracing this policy, in future generations they could enforce a product activiation policy like Microsoft's operating systems or other mainstream products, thus binding your game to your console exclusively. --------------------

This same licensing program has been applied to DVDs, and VHSs, and Sony's software for a long, long, long time. The second hand market is an illegitimate, yet essentially an un-prosecutable market--basically a very large grey area similar to that of importing game systems, or software. Or modifying your game console. Unless Sony plans on doing something bizarre like offering game titles through a downloadable service, then you're probably still going to see PS3 software at your local Gamestop. ...Psst, it's called intellectual property. --------------------

And a Bigger problem can be in there was a Small Malfunction in the game.
Making it Therefore you can't buy another copy that doesn't have the Malfunction.

Now that you bring that up, if Sony uses a similar system to Microsoft's software registration baseline, it might hurt second hand retailers, and Sony more than I expected.

Of course, they aren't going to catch everybody. People, and retailers will find a way around things. :P

It's also been said that Sony will be trading this off by removing region locking (so you can get and play import games without having to modchip), but it has not been confirmed.
