Well, it's finally here, a place to play make and share games! Or so they say, I think its just a place for people to mass upload poorly made games, but you do find some good ones every once in awhile

Probably this is nothing new for most of you but here is the official announcement.
YoYo Games is happy to announce that the new website http://www.yoyogames.com has now been been openend to the public.
The new site gives everybody the possibility to upload their Game Maker games, download games by others, review games and comment on them. It also contains a large section for the creators of games with information about and resources for Game Maker. The site includes a wiki, a messaging system and its own forum (which is meant for all visitors; for the creators the current GMC will remain available).
Our goal is to bring in not only the creators of Game Maker games but also the players, such that your games will be played a lot more.
The site is still in beta but it is fully functional and information and games added on the site will remain available when it goes out of beta. Some bugs might still exist and will be corrected and there might be some downtime for maintenance. Also, some small features might still be added.
The new site is just the beginning. Once beta testing is over we will start developing the next phase of the site, with many more features. Also we will develop Game Maker further and we will work on making many more resources available.
Already 250 games are available for download and we hope to increase this number considerably in the weeks to come. But of course we can only do that with your support. So we hope you will all join us on YoYo Games.

GM7's EULA never specifically disallowed fangames

Actually, I'm pretty sure it did. I'd have to check, but didn't it say something about not using other people's intellectual property? That's what a fangame is. I might be wrong on that, though.
Honestly, I don't think that they disallowed fangames because they don't want people making fangames. Otherwise, GM 6.1 would've done that. I think it's because they technically (according to my understanding of the EULA) own what you make on GM 7, so if a company decided to sue someone, it would be them.
I'm no lawyer, but I think that the no-fangame section is in there so that if someone does go to sue them, they'd be able to say that because it violates their EULA, it breaches the contract and doesn't belong to them. So they aren't trying to limit what you make so much as protect themselves (though I still don't like the "We own what you create" section).
At least, that's what I think, but that's not based off of anything I've heard (or read) YoYo Games say, so I could be entirely wrong.

It seems that may be the reason, but if they don't own them, why do they post them on their web-site?

Since I don't use GM7, I'm not sure about this, but isn't the update process automatic? If it was, and the games don't have to be approved by them, that would probably be a defense, as they can't regulate everything. If not, then I'm not sure. Maybe that's not the reason, it just seemed like that to me. Also, thanks, Grant.

I went through a period of time where I was angry at them, too, but I've thought about it, and though they're doing something that I think is immoral, they're not doing it illegally or anything.
I'm not going to recommend Game Maker 7 to anyone unless I find out that the EULA has been revamped to remove the parts I think are wrong, but there are a lot of other businesses that do the same sort of thing (I'm pretty sure that Wal-Mart tried (but failed, I think) to sue the person who came up with the yellow smily face a while ago, so that they could trademark it, and just about every pharmacy chain made copies of Airborne after the inventor didn't patent it), and if we focus on hating them, it's only a waste of our own time.
But, to stay on topic, even though it bothers me that people are unwittingly giving up their designs to YoYo Games, it's nice to have an easy list of games to see, instead of having to navigate the forums. And hey, some of them are made with GM6!
Oh, and by the way, I looked over YoYo Games's website's terms and conditions, and they don't sound too bad, as long as I'm understanding them correctly.
