The complaints fell on deaf ears Wednesday night when Bayville's acting village justice dismissed a summons accusing the girls' parents, William and Rachel Poczatek, of violating a village noise ordinance.

"I think the village did the right thing," William Poczatek said.

Poczatek said he was shocked when he and his wife were slapped with a summons. Sure, he said, Ashley, 11, and 5-year-old Chloe make noise when they're outside enjoying their aboveground swimming pool.

"What, are you telling me that a kid can't make noise?" he protested. "It's not fair."

The Poczateks were cleared because the ordinance is usually reserved for "the shouting and crying of peddlers, hawkers and vendors, which disturbs the peace and quiet of the neighborhood," their attorney said.

"The statute didn't apply," insisted attorney Andrew Campanelli, who got no argument from the judge or prosecutor.

Before the hearing, neighbor Sheila Brown said the children's squeals were not your usual brand of merriment.

"I have five dogs," Brown said. "Five dogs don't make this much noise. This is not something that started yesterday. They have been asked politely, but this is an ongoing issue far beyond children just playing in the pool."

Neighbors did not speak with reporters after the court proceeding.

Poczatek offered a conciliatory message: "Yes, we will try to keep them quieter."

Kids are gonna make noise when they're having fun. I was under the impression that adults were, you know, mature enough to deal with it. This is not a court-worthy case, and it's a good thing the judge dismissed it.

Edit: Granted, the parents could try and get their kids to quiet down a bit, but even if they don't, it's still not a court issue.

No, you simply do not understand.

I have those kinds of neighbors. Their kids, 5 and 6 I believe (the girl is already well over 100 pounds, eugh) play in their pool every day and SCREAM.

I'm telling you, every word that comes out of their mouth is a scream. They don't know what a normal tone is. I literally can not enjoy sitting back here, in the back television room, with the windows open. I'm forced to close them and turn on an air conditioner, and even then I can still hear them.

Parents don't know when to tell their kids to shut the **** up. I salute the people that sued those kids and their parents because I know what it's like first hand.

I have the same problem, except with two small boys. They always scream, every day. My computer room is the closest room to their house, and not only do they scream loudly, shey scream loudly all day in SPANISH. And they also ride around on those annoying little plastic tricycle things, and their plastic wheels make this horrible grinding noise you can hear through the walls. And the parents completely ignore them, even if they gouge their eyes out and start crying and yelling the parents don't even do anything.

These people have the right idea. It's okay to be a little loud now and then, but if you can hear them through the walls all day, every day, it has to be stopped.

I salute these people as well, they're setting an example for the rest of the country, and making the world a quieter place.

I'm not sure exactly what I think about the suing part, but I will say I certainly do see what Joey and Coelacanthus are saying. I ****ing can't stand noisy little brats making constant commotion. I have to experience a lot, what with my younger siblings who delight in shouting and screaming.

The kids in my neighborhood do it too. It's hot in florida so usually we keep the sliding glass doors closed, but during winter its nice to open it, the only problem is, the kids run around screaming at the top of their lungs ALL DAY long, I can totally understand the complaint.

It's not "squeels of laughter" its like loud-ass screaming and scattered giggling, but mostly annoying as hell shrieks.

If you think its bad to have screaming neighbor kids, then you don't know what its like to have screaming siblings

My brother is friggin 13 yrs old and he screams and yells and fights with my sister (8yrs old) all the time, its so annoying

like when I try to watch tv, some how they find there way over by me and scream and yell and through things, and I'm just trying to enjoy the x-files, I always miss the plot sad.gif

I can understand a limited amount of noise, because I live in a daycare I understand how it's so hard to get kids to be quiet. I can tell you it's a pain in the ass , especially when they are in the same room as you.

I can understand that some form of discipline should be taken in order to stop those insane children, but taking the issue to court is going a little too far.

I can sort of understand your complaints since I live on a street where every house has a kid under fourteen, and they're usually outside making a lot of noise. (And my six year old sister inside the house.) But it doesn't really bother me since I've learned to block out the noise, and I did it too when I was their age.
