Paper Mario, VERY VERY Early Beta

hi i a am making a Paper Mario game in game maker 7.
but i am wondering about copy writes like if i am aloud to sell fan game.

No you can't sell it.

Basically this.

Unless it's completely original.

As in, there's no Mario.

Or Mario Characters.

Or Mario styled stuff.

Or Mario music.

The idea has to be by you
The graphics must all be by you*
the programming must all be by you*
The music must all be by you*

*unless the original author has agreed to let you sell it

Or anything else that's copywrited.

It's safe to say that no fan-made games whatever that are based on an official game franchise are allowed to be sold, under any circumstances.

Is there a way to get the RSS feed of this topic? I just have to know how this ends.

well i talked to the people on the game maker community and they probably now WAYYYY more about copyrighting and they all said to contact Nintendo its easy!

I don't know who gave you that advice, but frankly it's horrible.

We fangamers know what we're talking about, since we have to know this stuff in order to stay out of legal trouble.

You can't sell fangames.


EDIT: Should have explained why it was horrible. It's a horrible idea because it's pointless. Of course Nintendo wouldn't give you (or any of us) permission to sell our fangames.

You don't get it, do you? Mario is a copyrighted character and property of Nintendo.

The only time that you could ever possibly sell a fangame is if Nintendo themselves agreed to arrange the selling for you, in which case it would be published under Nintendo's name

The other way is to, er... buy the franchise. And since Mario is the single best-selling video game series of all time, this is very unlikely.

Plus I'm not sure I'd PAY to play this from what I can see in the screenshot.

Well it says somewhere in the rules on nintendo.com that they appreciate their creativity, but it's better to keep it to your self. And plus, selling a fangame on a copyrighted character im pretty sure is illigal.

But it's probably to late now.

EDIT: And MTC is right, your game is too bland, try putting more plants/bushes, a better background and better clouds. It doesn't fit in that well.
