i doubt he'd trademark it anyway, and iirc doesn't have any legal force anyway and people generally use it because they usually won't get in trouble over it
yeah it could get nintendo a little more interested in c+d'ing mr but i doubt it

May 18th, 2009 NEWS: Before I make global changes, I'd like to have feedback on any issues you have. I'm 100% certain there are kinks that need to be worked out, since perhaps I'm completely overlooking them. Also if the FPS is below 40, inform me aswell. Download Link ► Playtest V.1Debugging keys: -Press "`" to switch party members. -Press "1" for Fire Flower. -Press "2" for Electric flower. -Press "3" for Wind Flower, -Press "4" for Ice Flower. -You can disable Flora from the pause menu.    There's a ton of actions to test out. I can't possibly name everything. It's best you don't know what does what though. -Known Problems- -Can sometimes swim when outside the water. Causes changes in x/y movements. -If you die, it goes into a constant death loop. Easy 1 event fix, but just restart the application to playtest again.(I'd rather not re-upload) -if you light the rope on fire, and you're NOT in the cannon, it still fires you. (wow how'd I miss that) -If you get hit with wind power with mario, AND the barrier is on, you lose your wings. however, you can still fly. - needs a "stop any sample playing" at start of game (in case you F2)
- Jumping feels awkward and heavy, and nothing like traditional Mario (or any platform movement, for the matter). Feels like variable jumping was only added for the sake of it.
- Wings don't flip with Mario
- Mario doesn't fall if you jump break a brick block while holding jump
- Swimming upwards in water should be jump, not up
- Vines are misleading. Makes you think you can grab them and don't feel like a part of the bg. Blur them, perhaps? EDIT: oh wait **** you can. But it's extremely difficult.
- I somehow managed to swim on land (if you walk up near the edges of the pool)
 - Mario loses his wings upon entering the menu and can't use the flying ability anymore
 - Jumping into ?-Block is awkward. Mario stays up in them for a few frames until he actually falls down. This could definitely be improved.
