It might be, but for the most part nothing happens.
It's more of a truce thing. We just make them, we don't sell them, nothing comes of it.
I'm talking Nintenod here though.
I know Capcom is ok with it.

It's also funny that there was this one guy trying to submit sprites he ripped from Toad Strikes Back, and someone said to him that he has to ask TD's permission to rip them. How many of the ripped sprites on the main site have been ripped with the permission of Nintendo? And TD's sprites weren't even custom, they were just edits.

That's my 0.02 €.

Dude. I live in Japan. If you've ever gone into a clothing shop and read the shirts here, you'll find that their English is so hilariously inaccurate, it's almost as if a 5 year old had been talking.

A Japanese to English translation isn't always accurate, so I wouldn't be suprised if those were the exact words on the document.

Technically, their form of English is called "Engrish", which is exactly how they pronouce the word "English". Their japanese word for english is "eigo", but if they are literally trying to speak english, they'll say "engrish".

doujin games are mostly illegal in america, but in places like japan, its fine to make them. its even ok to sell them for profit.

well, this is because of:

translating from japanese to english
from english to german
and later back to english

as lot of people know when you tell one a secret in its ear...
sometimes it "changed" a bit
but the mainmessage is the same.

I don't think you'll get in trouble for making a fangame based on a
copyright character.
But if you're getting paid for it then you could get busted.

Translators don't make writing mistakes. They may make mistakes like "this game is by our", but I think it sure the hell won't type "the Company allows no profite from fangames" and stuff like that.

8CM you mean? I think it was to confuse people, as some DVD/CD Drives don't support 8CM Disks. Also, they used a special Barcode on the Inside of the Disk so that people couldn't use plain 8CM Disks.

Legal is an on/off button. There's only one selection, either it IS illigal, or it is NOT. Stealing material from games IS illigal, no matter how you put it

It really depends on what you consider 'fair use' and what country are you in.
I can almost guarantee you that if you develop a Mario fangame on the districts of Africa, you're free to go.
Or in Iran, which doesn't have copyright laws anyway (anymore? I could've sworn I read somewhere they didn't)
