Making fan games illegal?

I'm pretty sure people use original sprites for originality, and not because it makes it less illigal.

If you ask them for permission, the answer is no. But if you do not ask, they have no problem. (Provided you do not make a profit) It may sound strange, but you can find my source for yourself if you like.
