I'm not exactly certain that a forum "democracy," per se, would work right, especially with such a large member base, but I'd sure as heck be willing to give it a try.
Either that, or simply having this happen: Staff makes a REFINED list of what they expect, fully defining what spam is, trolling is, flaming is, etc (so no "you can't spam, that's it" rules). The members, in turn, come together and make their own list of what they think would be the best rules (voting on what rules should stay/leave, in a sort of "proposal" and "support" fashion to decide what rules are even voted on). From there it's a simple matter of seeing where the staff and the members see eye-to-eye, then justifying the rules that they don't.
Ultimately, it's a good way to see what the members want, while at the same time allowing the members to see what the staff expects. In the end, the decision comes down to what the staff want, as they're the ones who do run this place, but at least then you'll have some understanding of what each group expects, rather than a constant back and forth, unhappiness, and such.
EDIT: Looking at this post, I'm not entirely sure what I said would work, either, given the member base. :/
